What documents are required to DONATE a property?
- National Identity Document (DNI) of the parties involved and, if it is a legal entity, the deed of incorporation, the deed of appointment of the representative and the deed of real ownership.
- Deed of ownership of the property to be donated or, failing that, a simple note from the registry.
- Certificate of occupancy (or application for the same by a competent technician), or final qualification certificate in the case of an officially protected dwelling.
- Energy performance certificate: This may not be required as it is not a requirement for either the deed or the registration. The buyer can therefore waive this requirement.
- Receipt for payment of property tax (I.B.I) for the last 4 years.
- Certificate of being up to date with community expenses.
- If the property is encumbered by a mortgage, a certificate of outstanding balance or zero balance is required.
Things to keep in mind:
When transferring an old house (more than 45 years since its construction), it is advisable to provide proof of the technical building inspection (ITE).
What happens if a property is donated without an Energy Performance Certificate (EPC)?
- The CEE is legally required for any transfer of habitable real estate.
- Although the notary will authorize the deed, the absence of the certificate may result in administrative fines imposed by the Autonomous Community.
What documents are required to DONATE money?
- Donor’s ID number (person who gives the money).
- D.N.I. of the donees (person who receives the money).
- Degree of kinship between donor and donee.
- Proof of the method of delivery of the money in question (photocopy of check and account number where it was charged; in the case of transfer, the charge and destination numbers must be provided).
If the donor or donee is a foreigner or not resident in Spain, what additional documentation must be provided?
- It is essential to provide the NIE or NIF of the non-resident.
- If the documentation is foreign, it must be duly apostilled (or legalized).
- If it is in another language, it must be accompanied by a certified translation.
In a donation of company shares or stock, what documentation is essential besides the ID of the parties involved?
- Documentation proving ownership of the shares (such as the deed of acquisition) is required.
- the current valuation of the same (through the company’s balance sheet).
- Register of Members and the Company’s Articles of Association.
